The California Supreme Court ruled in favor of Gilead Sciences, finding the company had no legal obligation to release newer HIV treatments sooner. Approximately 24,000 patients alleged Gilead intentionally delayed safer TAF-based drugs to maximize profits from older TDF-based products. These older treatments have been linked to kidney damage and bone density loss.
The court dismissed the negligence claims in a 6-1 decision. The majority opinion stated that imposing liability for injuries caused by nondefective drugs would threaten pharmaceutical innovation and public health. This ruling removes a significant legal and financial overhang that has impacted Gilead for years.
