Amazon is challenging a National Labor Relations Board (NLRB) order requiring it to recognize the Amazon Labor Union (ALU) and begin contract negotiations at its JFK8 warehouse in Staten Island, New York. The ALU won a historic union election there in 2022.
The case is before the U.S. Fifth Circuit Court of Appeals. Amazon refused to bargain, a required step for seeking judicial review of an NLRB certification. The company argues that the election was invalid, alleging improper influence by the union and the NLRB’s regional office, and is asking the court to overturn the certification.
The challenge is a key development in Amazon’s effort to resist the first successful unionization of one of its U.S. facilities. The dispute has lasted several years, and the workers have no collective bargaining agreement.
