New Mexico has asked a court to impose a penalty of $35 billion to $40 billion on Meta Platforms. The request follows a jury verdict on September 25, 2026, finding that Meta misled users about the privacy of their Facebook data in connection with the Cambridge Analytica scandal.

Meta called the proposed amount an “astronomical penalty” that would violate constitutional provisions. In court filings, the company asked the judge to cap the penalty at $3.45 billion.

Meta’s legal team argued that the company does not sell user data and that the state failed to prove that any consumer was actually misled by its practices. The judge is expected to decide later this month.
