A U.S. District Court in Delaware ruled against Liquidia in its patent dispute with United Therapeutics. The court found that Liquidia’s drug, YUTREPIA, infringed two claims of United Therapeutics’ ’327 patent, which relate to treating pulmonary hypertension associated with interstitial lung disease (PH-ILD). The court found four other asserted claims against Liquidia invalid.
After the ruling, Liquidia’s stock fell by more than 48%, while United Therapeutics’ shares surged. United Therapeutics has sought an injunction that could limit YUTREPIA’s availability.
Liquidia’s CEO said the company disagrees with the ruling on the two claims and will pursue all appellate options. The company also plans to ask the FDA to remove the PH-ILD indication from YUTREPIA’s label.
