Novo Nordisk filed a lawsuit in U.S. federal court against Eli Lilly for false and misleading advertising. The complaint targets marketing for Lilly’s weight-loss and diabetes medications, Zepbound and Mounjaro. This legal action escalates the competition within the rapidly expanding GLP-1 treatment market.
Novo Nordisk alleges that Lilly uses outdated clinical data to claim product superiority. The lawsuit claims Lilly compares its highest drug doses against lower, less effective doses of Wegovy and Ozempic. Novo Nordisk asserts that Lilly excludes data from newer, higher-dose versions of its own medications.
The Danish drugmaker seeks a court order to halt Lilly’s current advertising campaigns. Novo Nordisk also demands that Lilly run corrective advertisements. The lawsuit seeks damages, including profits Lilly earned from the disputed marketing. This action follows a cease-and-desist letter that Lilly allegedly ignored.
