Investors in FuelCell Energy, Inc. have until November 10, 2026, to seek appointment as lead plaintiff in a securities class action lawsuit. The lawsuit alleges that the company made false and misleading statements and failed to disclose material adverse facts about its business and prospects between June 24, 2026, and September 1, 2026.
The complaint alleges that FuelCell lacked the manufacturing capacity to meet the production rate required under a contract with Fit Energy. It claims this led to higher costs and manufacturing overhead.
On September 2, 2026, FuelCell reported a gross loss of $24.5 million for the third quarter. The loss was $5.1 million in the same period a year earlier. The report caused FuelCell’s stock price to fall.
