FuelCell Energy faces a federal securities class-action lawsuit for allegedly misleading investors about its manufacturing capabilities. The complaint claims the company made false statements regarding production rates required for a major agreement with Fit Energy USA LP.

The lawsuit covers the period between June and September 2026. It alleges FuelCell failed to disclose inadequate capacity that made financial charges likely.

On September 2, FuelCell announced a fiscal third-quarter net loss of $45.3 million. This included a $17 million charge related to the Fit Energy agreement.

The announcement triggered a significant decline in share price. Law firms are now recruiting investors who purchased shares during the class period to join the litigation.
